ABOUT THE FIRM

Decades of Experience in Healthcare Litigation...

Cases involving standard of care requirements or lawsuits involving developmentally disabled institutions, nursing homes, assisted living facilities or health care providers are unique because they present concerns that can have a serious impact on community perceptions of health care facilities and providers.

The York Legal Group, LLC can provide critical assistance by cohesively advocating the medical provider's position when claims arise. We vigorously defend cases involving a variety of health care clients including institutions,  for-profit and non-profit nursing homes.

For decades the attorneys at the York Legal Group have been shaping the landscape of health law through litigation.  Our firm is committed to providing our clients with great service and even better results.

The York Legal Group has built its reputation upon a commitment to service. Our clients know that we consistently provide the most thorough and aggressive representation of their interests.

Whether the attention is on the demands of the courtroom, or simply prompt communication with our clients, York Legal Group has survived and prospered primarily because of our ability to successfully provide such service.  Our Firm's name has become synonymous with the highest level of legal representation in areas of health care law, CRIPA, ADA, and federal class actions regarding disibility rights.
The firm practices in state and federal court, before agencies and arbitration panels, at both the trial and appellate level, and also has a general non-litigation civil practice.

The York Legal Group, LLC has attorneys licensed in the District of Columbia, the United States Supreme Court, every federal district court, and the States of Pennsylvania, Maryland and North Carolina.

York Legal Group, LLC specializes in litigation in connection with The Civil Rights of Institutionalized Persons Act (CRIPA), 42 U.S.C. ? 1997 et seq., which gives the Attorney General the authority to investigate conditions in public residential facilities and to take appropriate action if a pattern or practice of unlawful conditions deprive persons confined in the facilities of their constitutional or federal statutory rights.
From May 1980, when CRIPA was enacted, through September 1998, the Department investigated conditions in 327 facilities including but not limited to mental retardation and mental health facilities, as well as nursing homes. As a result of the Department's CRIPA investigations, many institutions were found to be out of compliance with the statute.
Our firm has represented many institutions during these investigations and has provided expertise through each stage of the Department of Justice investigation and CRIPA litigation.

The York Legal Group, LLC litigation department also specializes in providing counseling and litigation services involving regulatory dealings with CMS.  Our firm's representation may be in connection with the licensing stage, operating guidelines, survey procedures, communications with CMS, processing of appeals, or litigation concerning CMS funding.

Thomas B. York, Esquire has decades of experience in counseling clients dealing with CMS surveys and CMS funding issues.
Because this is a new area of regulatory involvement, and, due to the changing demographics of the United States population, the area of CMS Compliance is rapidly changing and expanding. Because the penalties for noncompliance are so severe, we counsel our clients to make every effort to stay up to date with the latest developments in CMS regulations.
